A contract will exist between the ‘Applicant’ and ‘White Rose Modern Funerals Limited’ for the sale of funeral arrangements.
Your continuing instructions will amount to your continuing acceptance of these terms of business.
The ‘Applicant’ is the person who signs either the Cremation 1 form or Burial order and is our ‘client’. Your instructions will not create any right enforceable (by virtue of the Contracts Rights of Third Parties Act 1999) by any person not identified as our client.
Payment terms
Our Fee Summary is an indication of the charges likely to be incurred based on the information and details we know at the time. While we make every effort to ensure the accuracy of the estimate, the charges are liable to alteration should arrangements alter by the family or where third parties change their rates or charges. When ashes caskets are required within 7 days, a shipping fee may be added to the cost, should we not hold the item in stock.
The actual amount of the charges will be detailed and shown in the final invoice we send.
VAT is not chargeable on funerals.
We accept payment by bank transfer. As a small business we don’t offer payment by card due to the excessive merchant fees charged to us.
Payment is requested within 7 days of invoice date, unless otherwise agreed by us in writing. If the final invoice is being paid by your late relative’s bank or solicitor, please let us know.
Late payment may result in interest being charged at a rate of 4% above our bank’s base rate from time to time in force; calculated (on a daily basis) from the due date of our invoice until payment; compounded on the first day of each month; and before and after any judgement (unless a court orders otherwise). We may recover (under clause 3) the cost of fees we incur for non-payment.
Such costs may include, but are not limited to, the following:
a. Debt collection agency fees;
b. Legal costs and court fees;
c. Administrative charges incurred by us in managing the recovery process.
Any recovery costs added to your account will comply with applicable laws and will not exceed the actual costs incurred in recovering the debt.
Your right to cancel
If for any reason you wish to cancel your arrangement with us, you may do so anytime before the funeral date. If the deceased is already resting at our mortuary, we will require a fee to cover our costs as set out in the (required by law) standardised price list
Personal items left on a deceased
When we collect a deceased from the hospital, it is most typical that the ward will usually have asked for family members to take any personal items or remove any jewellery so no personal items are left on a deceased. When it is the case that a personal item is left on a deceased, it is standard format for jewellery that a hospital will only describe the colour of the metal: White metal or Yellow metal – key characteristic descriptions such as stones or engraving are rare and subjective to each hospital’s own procedure.
The hospital will not sign any declaration from a Funeral Director should any description vary. Therefore we can only present to a family, what is on the body of the deceased from when we collected them.
We will inform the Applicant of any personal items present from when the deceased has been collected and is in our care, and ask whether the Applicant wishes for these to be returned. Jewellery will be described based on the colour metal or leather, and whether any stone or engraving is present. No personal item will be removed from a deceased unless the Applicant has requested for them to be returned.
When an item is removed from a deceased in our care it is immediately boxed and labelled with the deceased name and placed in our safe box, until it is returned to the family.
Should the Applicant not recognise the description of any personal items or jewellery we give, we require notification by email and we will require the Applicant to identify the body – in person at our mortuary or by video – still wearing the described item and the funeral cannot take place until this has happened. Should the Applicant wish to not ID the deceased we will require the Applicant to sign a disclaimer that they wish for the funeral to go ahead and they accept full responsibility for not recognising the personal items or jewellery description.
Our mortuary premises are monitored 24/7 by CCTV.
Complaints process
Should you have reason to raise a complaint, this must be raised by the Applicant only and sent by email to nick@whiterosemodernfunerals.co.uk
We will endeavour to answer any complaint within 48 hours and this will be overseen by the directors of White Rose Modern Funerals Ltd.
Privacy policy
We are committed to safeguarding the privacy of our customers. No funeral details will be given to any person who contacts us unless permission by email has been given by the Applicant. Customer details will not be passed on to a third party.
